Daily WinsTerms of Use
These terms cover the Daily Wins AI Habit Tracker iPhone app (the "app") and the dailywins.ai website (the "site"), operated by Daniel Gnecco ("we", "us"). By using the app or the site, you agree to these terms. If you don't agree, please don't use them.
1. The app license
The app is licensed to you under Apple's Licensed Application End User License Agreement (the "Standard EULA"), which is linked from the App Store listing. These terms add to the Standard EULA. If the two conflict on how the app is licensed, the Standard EULA wins.
2. Free features and Premium
The app is free to download. The free tier includes up to 3 habits, the morning check-in, your main win, the daily insight, your streak and flame, and widgets. Premium adds the AI-built Win Plan, the AI coach, unlimited habits, a weekly review, 3 Streak Freezes a week plus Streak Repair, and flame skins.
Subscriptions
- Premium is offered as a weekly, monthly or yearly auto-renewing subscription, and as a one-time lifetime purchase. On the US App Store on the date above, the prices were $2.99 per week, $12.99 per month, $29.99 per year and $79.99 lifetime. The App Store shows the current price for your country before you buy, and that price is the one that applies.
- The yearly plan includes a 7-day free trial for new subscribers. If you don't cancel before the trial ends, the yearly subscription starts and you're charged.
- Payment is charged to your Apple Account when you confirm the purchase. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- Manage or cancel any time: iOS Settings → your name → Subscriptions → Daily Wins. Deleting the app doesn't cancel a subscription.
- Refunds are handled by Apple under its policies. You can request one at reportaproblem.apple.com.
Other in-app purchases
Some one-time purchases, such as a Streak Repair, are consumable: they're used up when you use them and can't be restored or transferred.
3. AI features and your content
You keep ownership of what you enter in the app. You give us permission to process it only to provide the app to you, as described in our Privacy Policy. AI-generated plans, steps, insights and coach replies are suggestions. They can be wrong or incomplete, and you decide what to do with them. Don't rely on them for medical, psychological, legal, financial or safety decisions.
4. Wellness disclaimer
Daily Wins is a productivity and habit-building tool for general wellness. It isn't medical care, therapy or a treatment for any condition, and it isn't for emergencies. If you're struggling or think you may have a health condition, talk to a qualified professional. In an emergency, call your local emergency number.
5. Acceptable use
Don't misuse the app or the site. That includes interfering with how they work, trying to get around access controls or paywalls, reverse-engineering them except where the law allows it, using them to break the law, or putting other people's personal information into AI features without their permission.
6. The site and our guides
Guides on dailywins.ai are general educational information. Book titles, author names and trademarks mentioned belong to their owners. Our guides are independent commentary, and Daily Wins isn't affiliated with or endorsed by those authors, publishers or companies. Content on the site belongs to us unless stated otherwise. You may share links and short quotes with attribution.
7. Changes and availability
We may add, change or remove features, including which features are free or Premium, and we may update these terms. If a change materially affects you, we'll update the date above and, where appropriate, tell you in the app. Changes don't affect a subscription period you've already paid for.
8. Disclaimers and liability
To the extent the law allows, the app and site are provided "as is" without warranties of any kind, and we're not liable for indirect, incidental or consequential damages, or for lost streaks or data. Our total liability for any claim is limited to the amount you paid us for the app in the 12 months before the claim. Nothing in these terms limits rights you have under consumer-protection laws that can't be waived.
